PURPOSE AND GENERAL PROVISIONS
These Terms of Use (hereinafter, the “Terms”), together with any specific terms that may be established, govern the website www.segundamanopc.com (hereinafter, the “Website”) and the conditions applicable to the purchase of products through it.
The Website is owned by PRODUCTOS INFORMATICOS SERVICIOS INFORMATICOS S.L.U., with Tax Identification Number (C.I.F.) B01750181, whose registered office is located at C/ La Habana, Sur, S/N - 10005 Cáceres (hereinafter, “SEGUNDAMANOPC.COM.”).
Use of the Website services, as well as the purchase of any of the products offered, implies the Customer’s or User’s unconditional acceptance of each and every one of these Terms. Registration on the Website and use of its services means that the User’s data will become part of SEGUNDAMANOPC.COM.’s files and will be processed in accordance with the Privacy Policy, which the User expressly declares that they know and accept.
SEGUNDAMANOPC.COM. provides information about products and offers the possibility of purchasing them through the Website. Persons wishing to purchase products must complete the relevant registration form before beginning the purchasing process and follow the steps indicated by SEGUNDAMANOPC.COM. through the Website.
These Terms, together with the Website’s Privacy Policy and Legal Notice, are the only terms applicable to use of the Website and to the purchase of products through it, and supersede any other terms. Accordingly, any User who accesses the Website, registers and purchases products through the Website agrees to be subject to and bound by the Terms, Privacy Policy and Legal Notice as worded at the time the Website is accessed.
Any User registering on the Website must be at least eighteen (18) years of age.
GENERAL CLAUSES
1. All sales and deliveries made by SEGUNDAMANOPC.COM. shall be subject to these General Terms and Conditions. No modification, alteration or agreement contrary to SEGUNDAMANOPC.COM.’s Commercial Proposal or to the provisions herein shall take effect unless expressly agreed in writing and signed by the contracting parties, in which case such specific agreements shall prevail.
2. Due to continuous technical developments and product improvements, SEGUNDAMANOPC.COM. reserves the right to modify product specifications in relation to the information provided in its advertising where this may affect the value of the products offered, in which case the Customer will be informed during the sales process.
3. The identity and address of the supplier, product characteristics, price, transport costs and payment method shall be those specified on our Website at any given time and may be modified without prior notice depending on market circumstances.
PRODUCT INFORMATION
The product page contains the technical specifications, description, manufacturer’s brand and an illustrative photograph.
The purchased product may, due to manufacturer availability, be subject to non-substantial changes to the components, characteristics or specifications of the batch of which it forms part, provided that such changes do not result in a reduction in the advertised quality and performance.
Photographs, graphic or iconographic representations and videos relating to SEGUNDAMANOPC.COM. products, as well as trade names, trademarks or distinctive signs of any kind contained on the Website, are intended to provide as much information as possible. However, the User must bear in mind that they are for guidance purposes and are therefore not exhaustive.
SEGUNDAMANOPC.COM. reserves the right to decide, at any time, which products are offered to Users through the Website. Accordingly, SEGUNDAMANOPC.COM. may add new products to those included on the Website at any time and, unless otherwise provided, such new products shall be governed by the Terms in force at that time.
Likewise, SEGUNDAMANOPC.COM. reserves the right to discontinue access, at any time and without prior notice, to any of the products offered on the Website.
If, due to circumstances of force majeure, a product is unavailable after the purchase has been made, SEGUNDAMANOPC.COM. will inform the User by email of the total or, where applicable, partial cancellation of the order. Partial cancellation of an order shall not entitle the User to cancel the entire order, without prejudice to the User’s right of withdrawal in accordance with these Terms.
PRICE
1. Published prices are valid except in the event of typographical errors.
The prices, characteristics and availability of products sold by SEGUNDAMANOPC.COM. may vary. If any changes occur, the Customer will be informed before any order is accepted.
2. The price of the product shall be the price in force at the time the order is accepted by SEGUNDAMANOPC.COM. If a Customer places an order at an incorrect price, SEGUNDAMANOPC.COM. will inform the Customer of the correct price and, should the Customer wish to continue with the order, the corrected price provided by SEGUNDAMANOPC.COM. shall apply.
All product orders are subject to acceptance by SEGUNDAMANOPC.COM.
SEGUNDAMANOPC.COM. will not dispatch any product until its administration department has verified that payment has been made or that a cash-on-delivery payment request has been accepted.
3. In the event of total or partial non-payment by the Customer on the agreed due date for one or more product shipments, SEGUNDAMANOPC.COM. may suspend or cancel any pending shipment or Contract without incurring liability for any loss or damage, including loss of profit or damage arising from delay or loss of production suffered by the Customer. This right of SEGUNDAMANOPC.COM. shall under no circumstances release the Customer from their contractual obligations regarding outstanding payments and receipt of products.
4. If the Customer delays receiving or collecting the goods, SEGUNDAMANOPC.COM. shall be entitled to store the goods, at the Customer’s expense and risk, at its own facilities or those of a third party, and the Customer shall be required to pay the costs incurred by SEGUNDAMANOPC.COM.
PAYMENT METHODS
1. Card payment
Purchases may be paid for by bank card. The bank cards accepted are Visa and MasterCard. The purchase price will be charged to the Customer’s bank account within 4 days from the date of the order and payment will be considered effective once authorisation has been confirmed by the banking payment centres.
If the POS terminal (Point of Sale Terminal) reports that the card has been declined, the order will be automatically cancelled and the Customer will be informed online of such cancellation.
2. Bank transfer
This payment method shall not incur any cost for the Customer.
Refund amounts will be paid into the account specified by the Customer.
To pay an invoice, the following information must be included:
Invoice or order number, and the payment must be made payable to SEGUNDAMANOPC.COM.
Send proof of payment to info@segundamanopc.com, stating “proof of payment” in the subject line.
3. PayPal
Under this payment method, payment will be charged in accordance with the arrangements agreed between the Customer and PayPal. Likewise, where the company is required to refund any amount, the refund will be made using the same method.
This payment method may involve a cost for the Customer.
DELIVERY CONDITIONS
Delivery of the goods shall take place as follows unless otherwise agreed and without prejudice to the provisions of the following clauses:
1. Delivery shall be deemed to have taken place when the carrier has made the products available to the Customer and the Customer has signed the delivery receipt.
It is the Customer’s responsibility to inspect the products upon receipt and to record any reservations or claims that may be justified on the delivery receipt. SEGUNDAMANOPC.COM. may make delivery before the agreed date and may also make partial deliveries if it considers this appropriate. Such partial deliveries shall constitute delivery, transfer of risk and accrual of the corresponding price in respect of that delivery.
In accordance with Law 15/2009 of 11 November, the Customer is required to inspect the goods received and notify both the transport company and the seller of any incident within a period not exceeding 24 hours if the product is broken or physically damaged. It is particularly important to note that, in cases of visible damage, such as damaged packaging, the claim must be made at the time of receipt. For this purpose, the damage must be recorded on the carrier’s delivery note or, preferably, the order should be refused. We recommend the latter option, as it will allow us to arrange a replacement more quickly. If you notice that the package is not in suitable condition, has holes or impact damage, or the packaging is damaged, please refuse delivery. This will be at no cost to you and we will proceed to send you a replacement product. Simply notify the seller so that we can begin the replacement process. Please note that any claim made outside the period established by law may be rejected by the seller and by the transport insurer.
2. Collection from SEGUNDAMANOPC.COM. premises: Where this option is available, delivery shall be deemed to have taken place once full payment for the product has been received.
3. In all cases, delivery dates or periods shall be regarded as approximate and delay shall not constitute a material breach:
The delivery period will vary between 3 and 5 working days once the order has been approved and payment has been confirmed.
4. Deliveries will not be made to P.O. boxes.
5. If, at the time of delivery, you notice any irregularity in the package (open boxes, openings, detached sealing tape, obvious deformation of the package, etc.), please record this on the delivery note.
6. Deliveries are made during the daytime.
7. Items are protected and the packaging is adapted to the products we distribute.
8. The order will be cancelled in either of the following circumstances:
o Delivery cannot be completed after two attempts.
o It has not been possible to contact the Customer within 9 working days following the first failed delivery attempt.
9. SEGUNDAMANOPC.COM. shall not be liable for failure to fulfil its obligations where such failure results from events that could not have been foreseen or that, even if foreseen, were unavoidable, or from circumstances beyond its control, whether force majeure or unforeseen events, including but not limited to acts of government or public authorities, strikes by its own employees or third parties, lockouts, civil unrest, earthquakes and any other natural disasters, shortages or inability to obtain raw materials, supplies or equipment, failure of facilities, etc.
10. Except as otherwise provided in these General Terms and Conditions, SEGUNDAMANOPC.COM. shall not be liable for any loss or damage arising from delay in or failure to deliver the goods, particularly loss of profit or any consequential loss or damage resulting from delay or loss of production suffered by the Customer as a consequence of such delay.
11. Returns will only be accepted in the event of a justified delivery error and only in respect of products that have not been unsealed or whose original packaging remains unopened and intact.
SHIPPING METHODS AND COSTS
Products may be delivered as follows:
1. The Customer may collect the order from our premises at no additional cost.
2. Where products must be shipped within mainland Spain, shipping costs will depend on the type of goods and will be calculated in accordance with the following indications:
Delivery by transport agency shall be charged according to the corresponding value in the following table, calculated on the basis of the product’s weight:
Prices for larger quantities will receive a percentage discount depending on the total weight of the items.
Shipping costs include handling and packaging costs, as well as postage. Handling costs have a fixed price, while transport costs may vary according to the total weight of the package:
o We recommend grouping all your items into a single order.
o We cannot combine two separate orders, and shipping costs will be applied to each order individually.
We do not ship to the Canary Islands for logistical reasons.
For deliveries of more than 5 units, please first contact us by telephone on 927 226 715 to confirm the applicable rate.
RETURNS
PLEASE CHECK THE CONTENTS, CONDITION AND FUNCTIONALITY OF THE PRODUCTS IMMEDIATELY AFTER RECEIVING THEM.
If you detect any irregularity or inherent defect, please contact us immediately. We will try to resolve the issue as quickly as possible.
IMPORTANT: After receipt of the package, claims relating to damage caused during transport will not be accepted. If you notice any irregularity or damage to the shipping box, you must report it directly to the delivery driver and record it on the delivery note when receiving the goods.
If you are not satisfied with your purchase and are within the first 30 days, you may return it and receive a refund for your order. Where a refund is due, it will be made using the same payment method used for the purchase. Please note that in such cases shipping costs, both for delivery and return, are non-refundable and shall always be borne by the Customer. We recommend sending returned goods using insured shipping, as we are not responsible for damage caused by the carrier while the goods are being returned to our premises.
Returned items must be in perfect condition, together with their original packaging and any warranties, manuals, accessories, seals and bags, where applicable, which must remain unbroken.
All exchanges and/or refunds will be processed once SEGUNDAMANOPC has checked the condition of the returned items. Before making a return, you must contact SEGUNDAMANOPC customer service so that we are informed of your intention to return the product and can provide you with the appropriate service.
Returns will not be accepted for products which, by their nature, cannot be returned (consumables, software, microprocessors, non-standard products specifically ordered for the Customer, products custom-developed for the Customer and services), or products capable of being downloaded or reproduced immediately for permanent use (Law 47/2002 of 19 December on Retail Trade, Article 45).
Orders may be cancelled except where this is specifically indicated when order confirmation is received (for example: special factory or import orders, parts manufactured at the Customer’s request, products not normally held in stock due to their special characteristics, etc.).
IMPORTANT: It is the Customer’s responsibility to prepare the return package correctly. Courier and postal services do not prepare the package, so the Customer must send the product in its original packaging placed inside another properly protected package so that the original packaging is not damaged.
SEGUNDAMANOPC.COM. will not accept products for exchange or return if they are returned without suitable packaging.
Returns may be made either in person or through a transport agency, always following the instructions of our customer service department. Returns sent carriage forward will not be accepted. SEGUNDAMANOPC.COM. may inspect the contents before accepting receipt in order to verify that they are in perfect condition.
Receipt of returned goods shall under no circumstances imply acceptance or confirmation of their condition. SEGUNDAMANOPC.COM. shall therefore have a period of 15 days to notify the Customer of any damage found in the returned product, compensation for which shall be payable by the Customer.
All our products are imported from the EU and are subject to fluctuations in price and stock, and therefore it may not always be possible to process such a return.
WARRANTY
The Customer shall use the goods in accordance with the manufacturer’s user manual and instructions. SEGUNDAMANOPC.COM. shall not be liable for any loss or damage suffered by the Customer or by any third party arising from failure to comply with the instructions contained in the user manual or the safety rules applicable to the goods. SEGUNDAMANOPC.COM. shall not be liable for incorrect configuration or installation, or for faults in equipment caused by a component not supplied by SEGUNDAMANOPC.COM.
All our products have a minimum warranty of thirty days. Please consult us regarding other warranty options or warranty extensions. You may make use of this warranty by providing your proof of purchase (invoice).
Please remember that, for your product to remain under warranty, it must meet the following requirements:
o - All items sold by SEGUNDAMANOPC.COM. are covered by the statutory warranty (Consolidated Text of the General Law for the Protection of Consumers and Users, RDL 23/2003, with reference to second-hand goods) for a period of one year from the date of delivery.
- The warranty for consumables (i.e. toner, floppy disks, CD-ROMs or similar items) shall be the warranty provided by the relevant manufacturer in each case.
o - The warranty shall become invalid in the following circumstances: impacts and/or improper transport; defective installation and/or installation errors; installation and/or connection of peripheral devices incompatible with the product; incorrect supply voltage; handling by personnel other than SEGUNDAMANOPC.COM.’s or the manufacturer’s technical service; tampering with any seal or identification/control label; fault or negligence by the Customer or a third party; normal wear and tear through use; damage caused by natural phenomena or disasters such as storms, floods, lightning, earthquakes, fires, etc., whether or not they affect the electricity supply; and incidents caused by software problems or computer viruses.
o SEGUNDAMANOPC.COM.’s warranty shall cease to be valid if any item is modified, altered or replaced without the express consent by email of SEGUNDAMANOPC.COM.’s technical department.
o - In carrying out repairs, SEGUNDAMANOPC.COM. may replace individual parts or the entire unit as it considers appropriate. Classification of the problem and determination of whether or not it is covered by the warranty shall be the responsibility of SEGUNDAMANOPC.COM. Any repair or replacement must be authorised by SEGUNDAMANOPC.COM. Transport costs and risks for sending defective products shall be borne by the Customer. Once repaired, the product will be returned carriage paid if covered by warranty; carriage forward if outside the warranty or if it must be sent to locations outside mainland Spain. For products purchased at our premises, the RMA procedure shall be handled solely and exclusively at our premises.
o - In the event of any lack of conformity between the product specifications and those stated by the manufacturer, or claims concerning apparent defects or faults in materials or workmanship, quality, quantity or other matters, the Customer must notify SEGUNDAMANOPC.COM. in writing using a method that provides evidence of receipt.
o - Repairs shall require presentation of a copy of the invoice or receipt/proof of purchase and a detailed description of the defects. Where the manufacturer provides a technical support service for its product, the Customer may contact that service directly.
o - The Customer is required, at their own expense and risk, to make a backup copy of their data before delivering the product to SEGUNDAMANOPC.COM. for repair or testing. SEGUNDAMANOPC.COM.’s total liability, on any grounds whatsoever, shall under no circumstances exceed the total value of the defective goods supplied. Except as provided in this clause, SEGUNDAMANOPC.COM. shall under no circumstances be liable for any loss or damage, particularly loss of profit, or loss or damage arising from anticipated results, delay or loss of production. Any liability for loss of or damage to information or data records is also expressly excluded. In all cases, the Customer shall be required to make the appropriate backups necessary to reconstruct any lost or damaged data.
o - The compensation provided for in this clause shall exclude any other compensation arising from defects or deficiencies in quality or quantity.
LIABILITY
SEGUNDAMANOPC.COM. shall not be liable for delays in the delivery of orders or inability to complete delivery where the cause is an event of force majeure and is therefore beyond our control. Without limitation, force majeure shall be understood to include the following circumstances: accidents; strikes; riots; terrorist threats or attacks; fire or explosion; weather-related events or natural disasters such as storms, floods, earthquakes, subsidence or epidemics; and problems beyond our control affecting means of transport or telecommunications systems. As far as possible, once the cause of the inability or delay has ended, SEGUNDAMANOPC.COM. will make every effort to resume its commercial activities and fulfil its obligations and shipments.
APPLICABLE LAW
This Legal Notice shall be governed in all respects by Spanish law. The parties expressly waive any jurisdiction to which they may otherwise be entitled and submit to the Courts and Tribunals of Cáceres.
SEGUNDAMANOPC.COM. shall pursue any breach of these legal terms, as well as any improper use of this portal, exercising all legal actions available to it under applicable law.
